SCOPE AND ACCEPTANCE

These Terms of Service govern access to maisonatlas.ca and purchases made from MAISON ATLAS.

By visiting our website, creating an account, placing an order or otherwise using our services, you agree to these Terms of Service and to our Privacy Policy, Refund Policy and Shipping Policy.

Nothing in these Terms limits or excludes any mandatory consumer right or legal warranty available under the Consumer Protection Act, the Civil Code of Québec or any other applicable Canadian consumer-protection legislation.

If any provision of these Terms conflicts with a mandatory legal requirement, the mandatory legal requirement will prevail.

ELIGIBILITY AND ACCOUNTS

You must have reached the age of majority in your province, territory or country of residence, or use the website under the supervision and authorization of a parent or legal guardian.

You are responsible for providing accurate, current and complete information and for protecting your account credentials. You must notify us promptly if you suspect unauthorized access to your account.

We may suspend or restrict an account where reasonably necessary to prevent fraud, protect customers, comply with the law or address a material violation of these Terms.

STORE AND PRODUCTS

MAISON ATLAS offers curated products across categories that may include home, beauty, jewelry, fragrance, fashion and personal style.

We make reasonable efforts to display product descriptions, photographs, colours, dimensions, materials, specifications and care instructions accurately. Screen settings, lighting and ordinary manufacturing variations may cause minor differences.

Product-specific information, restrictions, warnings, compatibility requirements, dimensions, materials and care instructions displayed on the product page form part of the offer.

Product availability may change without notice. We may limit quantities where reasonably necessary to prevent fraud, unauthorized resale, inventory errors or abuse.

PRICES, TAXES AND CURRENCY

Unless clearly stated otherwise, all prices are displayed in Canadian dollars (CAD).

Applicable taxes, shipping fees and other calculable charges will be disclosed before the customer submits the order.

For international orders, customs duties, import taxes, brokerage charges or other third-party fees that cannot reasonably be calculated by us may be payable by the recipient. Where applicable, this possibility will be disclosed before purchase.

We may correct genuine pricing or description errors. If an error affects an order already placed, we will contact the customer before fulfilment and provide the option required by applicable law, including cancellation and reimbursement where appropriate.

PAYMENT

Payments are processed through authorized third-party payment providers. MAISON ATLAS does not normally receive or retain complete payment-card numbers.

The customer confirms that they are authorized to use the selected payment method and that the billing information provided is accurate.

We may delay, reject or cancel a transaction where payment authorization fails or where reasonable fraud, identity, security or legal concerns exist.

ORDERS AND CONTRACT FORMATION

Submitting an order constitutes an offer to purchase.

Before submitting an order, the customer will have an opportunity to review, correct or cancel the proposed transaction.

A contract is formed when we send an order confirmation, subject to payment authorization, product availability and applicable law.

We may reject or cancel an order for legitimate reasons, including:

• Payment failure.
• Suspected fraud or unauthorized use.
• Pricing or inventory error.
• Incorrect or incomplete customer information.
• Product unavailability.
• Legal or shipping restrictions.
• Orders placed for unauthorized resale or abusive purposes.

If payment has already been captured for an order that we cancel, the amount paid will be refunded to the original payment method.

For Québec distance contracts, the information displayed before purchase and the electronic order confirmation form part of the written contract. A copy will be provided electronically within the period required by law.

SHIPPING AND DELIVERY

Available shipping methods, charges, processing times and estimated delivery windows will be displayed at checkout, on the product page or in the order confirmation.

Delivery dates are estimates unless expressly identified as guaranteed. Delivery may be affected by carrier delays, customs processing, weather, emergencies, incorrect addresses or other circumstances beyond our reasonable control.

The customer is responsible for providing a complete and accurate delivery address.

Our Shipping Policy forms part of these Terms. Nothing in these Terms limits any mandatory cancellation or refund right arising from delayed or failed delivery.

RETURNS, REFUNDS AND EXCHANGES

Returns, refunds and exchanges are governed by our Refund Policy.

Customers must contact returns@maisonatlas.ca before returning a product and must follow the return instructions provided.

We may reasonably refuse a voluntary return where the product has been used, damaged after delivery, altered, returned incomplete or falls within a legally permitted non-returnable category.

This does not limit rights relating to defective, damaged, unsafe, incorrectly supplied or misrepresented products.

LEGAL WARRANTIES

Products purchased by Québec consumers are covered by the mandatory legal warranties provided by the Consumer Protection Act and the Civil Code of Québec.

Products must be fit for their normal use, conform to their description, remain usable for a reasonable period considering their price and intended use, and be free from hidden defects as required by law.

No provision of these Terms or our other policies excludes or limits a mandatory legal warranty.

CUSTOMER RESPONSIBILITIES

Customers agree to:

• Provide accurate contact, billing and shipping information.
• Read product descriptions, measurements, warnings and instructions before purchase.
• Use products safely and according to their intended purpose.
• Inspect deliveries within a reasonable time.
• Contact us promptly regarding damaged, missing, defective or incorrect products.
• Avoid fraudulent chargebacks and first contact us to attempt to resolve a legitimate problem.
• Retain relevant order confirmations, receipts, photographs and shipping records when making a claim.

PROHIBITED USE

You may not use our website or services:

• For unlawful, fraudulent or deceptive activity.
• To infringe intellectual-property, privacy or other legal rights.
• To upload malicious software or interfere with website security.
• To impersonate another person or submit false information.
• To make unauthorized purchases or payment transactions.
• To scrape, reproduce or exploit protected content commercially without permission.
• To harass, threaten or abuse customers, employees, contractors or service providers.
• To place orders intended for unauthorized resale, fraud or abuse.

We may take reasonable protective measures, including cancelling suspicious orders or restricting access, subject to applicable law.

INTELLECTUAL PROPERTY

The MAISON ATLAS name, branding, original text, graphics, website layout, photographs and other original materials are owned by or licensed to ATLAS NORTH GROUP INC.

They may not be copied, reproduced, distributed, modified or used commercially without prior written authorization, except where permitted by law.

Third-party trademarks and materials remain the property of their respective owners.

CUSTOMER REVIEWS AND SUBMISSIONS

If you submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, translate and adapt the submitted content for operating and promoting MAISON ATLAS, subject to applicable privacy and consumer-protection laws.

We may remove content that is unlawful, fraudulent, abusive, misleading, defamatory, infringing or unrelated to the relevant product or service.

We will not prevent or suppress an honest review solely because it is negative.

THIRD-PARTY SERVICES

Our store is hosted by Shopify and may use payment, shipping, analytics, customer-review, communication, security and advertising providers.

Independent third-party services may be governed by their own terms and privacy policies.

MAISON ATLAS remains responsible for its obligations to consumers and for personal information as required by applicable law.

FRAUD AND CHARGEBACKS

We may use reasonable verification and fraud-prevention measures to protect customers and MAISON ATLAS.

Where a customer does not recognize a transaction or believes an order is incorrect, the customer should contact billing@maisonatlas.ca or support@maisonatlas.ca promptly.

Nothing in this section prevents a customer from exercising a lawful right to dispute a transaction. Knowingly submitting false claims, fraudulent chargebacks or fabricated evidence may result in account restrictions and other remedies permitted by law.

WEBSITE AVAILABILITY

We use reasonable efforts to maintain a secure and functional website, but uninterrupted or error-free access cannot be guaranteed.

We may temporarily restrict access for maintenance, security, system updates or circumstances beyond our reasonable control.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, MAISON ATLAS and ATLAS NORTH GROUP INC will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable.

This limitation does not exclude or restrict liability that cannot legally be excluded, including liability arising from:

• Mandatory consumer rights.
• Legal warranties.
• Fraud or intentional misconduct.
• Gross fault.
• Personal injury.
• Obligations concerning personal information.
• Any other liability that applicable law prohibits us from excluding.

INDEMNIFICATION

To the extent permitted by law, a user who violates these Terms or unlawfully infringes the rights of MAISON ATLAS or a third party may be responsible for the direct losses and reasonable costs caused by that violation.

This provision does not apply where it would improperly restrict a consumer’s mandatory legal rights.

PRIVACY

The collection, use, disclosure, retention and protection of personal information are governed by our Privacy Policy and applicable Canadian and Québec privacy laws.

GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Québec and the applicable federal laws of Canada.

Nothing in these Terms deprives a consumer of mandatory protections available under the laws applicable in their place of residence.

For Québec consumers, disputes may be brought before the competent courts in accordance with mandatory Québec law. Nothing in these Terms requires a consumer to waive a legally protected forum or remedy.

Before beginning formal proceedings, customers are encouraged to contact support@maisonatlas.ca so that we may attempt to resolve the matter promptly and fairly.

SEVERABILITY

If any provision is found invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted or severed where necessary. The remaining provisions will continue in effect.

NO WAIVER

A failure or delay in enforcing a provision does not constitute a waiver of that provision or any other right.

CHANGES TO THESE TERMS

We may update these Terms prospectively to reflect changes in our services, business practices or legal obligations.

The version applicable to an order is the version presented when the order is placed. Material changes will be communicated where required by law.
